Terms of Service

1. Who we are

The “kreatyvai” service (the Service) is provided by MB KETO group, company code 305500514, VAT number LT100013061016, registered address Perkūnkiemio g. 19, LT-12120 Vilnius, Lietuva, email info@kreatyvai.com (“we”). These terms are the agreement between you and us and apply to both consumers and business customers. By using the Service you agree to these terms.

2. The Service

The Service helps you create static ads (images) and ad copy based on the materials you upload: previous ads, logos, brand guide, product photos, descriptions and offers. Ads are created through an automated multi-step process that includes artificial intelligence models. We may improve and change the Service's features while keeping its core purpose.

3. Account

• Accounts may be created by adults and companies. If you create an account on behalf of a company, you confirm that you're authorised to represent it – the company is then the contracting party.
• Provide a valid email address – we use it to send important account and payment information. You are responsible for keeping your login details confidential.
• You can delete your account at any time in your account settings. Deleting the account cancels any active plan, and your data is deleted as described in the Privacy Policy.
• We may suspend or close an account used in breach of these terms or the law. We'll notify you by email unless the law prevents us from doing so.

4. Plans, points and payments

• The Service is measured in points: a new ad or a variation costs 3 points, a change on request costs 1 point. Other sizes (4:5, 9:16, 1:1) and the editor cost nothing extra.
• New accounts receive 30 free points once.
• Plans are subscriptions billed monthly or yearly in advance (yearly billing – 25% discount). Subscriptions renew automatically until cancelled. Prices are shown on the website in euros and include 21% VAT; EU businesses with a valid VAT number and customers outside the EU pay the price excluding VAT. We issue a VAT invoice for every payment. Payments are processed by Stripe.
• Plan points are granted every month (including yearly plans) and do not roll over to the next month.
• Extra points you purchase are valid for 30 days from purchase; points not used within that time expire. Gifted points remain valid while the account is active. Points cannot be exchanged for money.
• You can cancel your plan anytime in your account. It stays active until the end of the paid period, after which no further payments are taken.
• When upgrading, the price difference for the remaining period is charged immediately and points are added immediately. When downgrading, the new price applies from the next period.
• If an ad can't be created because of an error on our side, the points are refunded automatically.
• You can try the Service for free before buying. By purchasing a plan or points you ask us to start providing the service immediately and agree that you lose the 14-day right of withdrawal once it has started. Used points and an already started paid period are not refunded.
• We may grant free points every month to users on the free plan. This is a gift whose size and conditions we may change.

5. Your content

• The materials you upload remain yours. You grant us the right to use them only as needed to provide the Service.
• You confirm that you hold the rights to the logos, photos, texts and trademarks you upload.
• You may use the ads you create without restriction, including for commercial purposes.
• We don't use your content to create ads for other customers, don't show it publicly without your consent and don't share it with third parties except service providers (see the Privacy Policy).

6. Responsibility for ads

Ads are created by an automated system based on the information you provide. Review them before publishing: you are responsible for the claims, prices and discounts in your ads and for their compliance with the law and advertising platform policies (e.g. Meta). We don't guarantee ad results (sales, cost per result or platform approval) – they depend on many factors outside our control.

7. Prohibited

• Creating misleading, illegal or rights-infringing ads.
• Advertising goods or services whose advertising is prohibited by law.
• Uploading materials you don't hold the rights to.
• Attempting to breach the security of the Service, scraping data, circumventing points accounting or reselling the Service without our consent.

8. Availability and liability

We work to keep the Service running without interruption, but we don't guarantee that it will always be available or error-free. We aim to schedule maintenance at low-traffic times.

For business customers, our liability is limited to the amount paid for the Service in the last 3 months and excludes indirect losses (e.g. lost profits). These limits don't apply to damage caused intentionally or through gross negligence and don't restrict consumers' statutory rights.

9. Changes to these terms

We'll notify you of material changes by email or in the Service at least 14 days in advance. If you don't agree with the changes, you can cancel your plan or delete your account before they take effect.

10. Disputes

The law of the Republic of Lithuania applies. We aim to resolve disputes through negotiation – write to info@kreatyvai.com.

Consumers also benefit from the mandatory consumer protection rules of their country of residence. Consumers may contact the State Consumer Rights Protection Authority of Lithuania (www.vvtat.lt) or the consumer dispute resolution body in their country. Disputes with business customers that can't be settled by negotiation are resolved by the courts of the Republic of Lithuania at our registered office.
